Juro-Terrorism and Why Most Floridians Don’t Own a Home

In the State of Florida, roughly 29% of homes are owned, mortgage-free. This means that most Floridians do not own their homes and may not be able to pass on ownership to their families. To make matters worse, Florida has consistently led the nation in foreclosures, and is also the sole state where the most Americans are losing their homes. There is a reason for this: Juro-Terrorism.

Juro-Terrorism is the act of judges abusing public trust to rig court proceedings and ruin the lives of Americans. Juro-Terrorism is most commonly discovered during foreclosure proceedings where Americans who should otherwise remain in their homes, lose their homes to predatory liens. In Tampa, judges are accelerating foreclosures due to HOA liens, and in Orlando lawyers are placing liens on homes in HOA communities for “attorney enforcement fees”, despite no actions pending in court. They are even foreclosing on homes in HOAs operated by individuals who are not licensed CAMs. Most foreclosures are scams, but Florida judges accelerate them anyway.

Mortgage companies and banks love the State of Florida because of the ease with which our judges allow them to accelerate these foreclosures. But what most victims don’t know is that Florida law (which is drastically different from the people trusted to uphold the law) does not recognize HOA liens and mortgages as possessory interests. But residents are having their homes taken anyway, especially when they do not know the law, or cannot afford a good attorney.

THE ANSWER

As Governor of the State of Florida, Moe Dimanche, a No Party Affiliation candidate for Florida governor this year, promises to reign in Juro-Terrorism, and keep Floridiians in their homes. Most importantly, Moe will implement a policy modeled after efforts implemented in Michigan and Maryland that allows first-time home owners a realistic opportunity to own a home that they can pass on to their loved ones. The City of Baltimore implemented a program called the Fixed Pricing Program that allowed Americans in pursuit of home-ownership to buy a home for just $1. The catch: they had to use the home as their primary residence.

This is a great way to ensure that college graduates and young married couples have an opportunity to achieve an affordable life in the State of Florida. What the statistics surrounding Florida foreclosures don’t tell you is that most foreclosures are unopposed. Properties sometimes become abandoned when people pass away without heirs or family members who carry on their legacies. What happens in Juro-Terrorism is that judges abuse the “guardian ad litem” appointment process and essentially assign the rights of an estate over to an appointed attorney who will allow the home to go into foreclosure unchallenged, and the home then proceeds to a forced sale. Oftentimes, local comptrollers allow fake mortgages to be recorded against these abandoned properties when opposition is not expected. Why not allow everyday Floridians struggling with affordability to benefit from making productive use of these abandoned properties instead of allowing mortgage companies and banks to enrich themselves?

Moe says it is time to give that opportunity to the People.

The State of Florida will implement a program that takes these properties and allows Floridians to procure title to these properties pursuant to Florida’s Adverse Possession statutes. The state will provide the residence, but the claimant will be required to do the following:

  1. Declare that they intend to make the home their permanent residence
  2. Pay the taxes on the property for 3 consecutive years
  3. Take responsibility for any improvements needed to fix the property up
  4. Agree to never rent the property

In order to qualify, the claimant must be one of the following:

  1. A recent college graduate
  2. A married couple under 35 with dependents
  3. A veteran
  4. Over the age of 65

Other groups are not inherently excluded, but college graduates, married families and the elderly will take top priority. That way, we can ensure that college graduates have a realistic opportunity to make the most of their fresh degrees, parents can comfortably raise their children without stress, and elders and veterans are taken care of at their most vulnerable moments.

Home ownership is the foundation of an affordable way of life. It is often our biggest expense, and relief from that will allow Americans to make the most of their lives with the little that they have.

The DeSantis Factor

Governor Ron DeSantis serves the rich. This was obvious when he tried to turn our state parks into golf courses and Floridians united to tell him no. After a TikTok video went viral of a man from Venezuela encouraging squatting, DeSantis used the video as an opportunity, not to actually stop squatting, but to abolish Florida’s Adverse Possession laws. These are two distinct things. This was not a response to a “squatting” problem in Florida at all, but a red herring used to help protect a system that helps the rich get richer.

The effort failed, because the government relies on Adverse Possession (which is a part of how the Orlando International Airport was procured). They wanted to totally abolish adverse possession in Florida, a common law doctrine, but essentially kept it the same. Why did DeSantis attempt this? Because DeSantis allies at the Lowndes law firm were, at the time, on the losing end of a property dispute that pit adverse possession against the act of Florida probate lawyers writing themselves into the estate documents of “clients”, and they were set to lose. The effort was initially sponsored by Duke Energy and a committee of probate lawyers, but when it became too obvious that the changes were designed to protect this system, they changed the sponsors on August 3rd, 2024.

Under DeSantis, mortgage companies and probate lawyers benefit greatly from a state administration that favors enrichment for the rich. Under Moe, it will be the opposite: abandoned properties will be entered into a lottery system for college graduates, married couples with children, veterans, and the elderly. This is a future where our veterans are well taken care of, our elders are safe, and our young people can actually make the best of their futures.
